Directive Speech Acts in Courtroom Cross-Examination: A Comparative Pragmatic Analysis of Ghanaian and British Legal Discourse Using an Interactional-Discursive Speech Act Framework

Abstract

This study examines directive speech acts in courtroom cross-examination, situating the analysis within a revised speech act theoretical framework that integrates Austin’s (1962) and Searle’s (1969) foundational accounts with subsequent developments in interactional and discourse-functional pragmatics (Levinson, 1983; Sbisà, 2001; Fetzer, 2010). The research draws on a corpus of 120 cross-examination transcripts from Ghanaian and British courtroom proceedings, enabling a comparative analysis of directive formulation and pragmatic force across two distinct common-law-influenced legal systems. The study identifies four principal directive strategies: information-eliciting questions designed to extract factual testimony under constrained response conditions; statement-implication questions that embed assertions within interrogative structures; confrontation directives that explicitly challenge witness credibility or narrative consistency; and repair-inducing directives aimed at eliciting clarification or correction of testimony. Findings demonstrate that courtroom directives operate beyond the scope of traditional Searlean classifications of illocutionary force, as they frequently combine multiple pragmatic functions simultaneously, including control of narrative, management of institutional authority, and strategic positioning of legal actors. In light of this complexity, the study proposes a multi-level analytical model that accounts for the interactional dynamics of turn-taking, the institutional constraints of courtroom procedure, and the ideological underpinnings of adversarial legal questioning. This model provides a more fine-grained account of directive speech acts as contextually embedded communicative actions rather than isolated sentence-level functions. The study contributes to legal pragmatics, speech act theory, and courtroom discourse analysis by demonstrating how directive force is systematically shaped by institutional power relations and discursive strategy in judicial settings.
